DMCA Notice and Takedown Policy

Travelinium ("we", "us", or "our") is committed to respecting the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines our procedures for handling claims of copyright infringement on our travel blog located at travelinium.com (the "Site"). We comply with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. ยง 512.

How to File a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Site, please notify our Copyright Agent by providing the following information (a "DMCA Notice"):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Sufficient identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Site are covered by a single notification, a representative list of such works.
  • Sufficient identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s)).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the DMCA Notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA Notice, we will expeditiously remove or disable access to the allegedly infringing content and notify the user responsible for the content.

Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification (a "Counter-Notice") to our Copyright Agent containing the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material previously appeared (e.g., URL(s)).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court (i) in the judicial district where your address is located, or (ii) if your address is outside the United States, for any judicial district in which Travelinium is located, and that you will accept service of process from the person who submitted the DMCA Notice or their agent.

We will promptly forward valid Counter-Notices to the complainant. If the complainant does not notify us within 10-14 business days that they have filed a lawsuit, we may restore the material.

Repeat Infringer Policy

We maintain a policy of terminating, in appropriate circumstances, the accounts or access rights of users who are deemed to be repeat infringers under the DMCA.

False Notices

Submitting knowingly false DMCA Notices or Counter-Notices may result in liability for damages, including costs and attorneys’ fees.

Changes to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes constitutes acceptance.
